Generally speaking, Virginia is an “at will” employment state. This means that an employer can fire an employee at any time for any reason and that an employee can quit any time for any reason. There are exceptions to this general rule however.
Wrongful terminations occur when an employee is fired because of discrimination, retaliation, or harassment. There are many protected classes and a combination of Federal and Virginia state laws prohibit firing because of:
- National Origin
- Genetic information
- Past, current or prosecpective military service
- Protected whistleblowing activity
Likewise, an employee cannot be fired because they sought or took protected leave such as leave under the Family and Medical Leave Act (FMLA) or the Americans with Disabilities Act (ADA).
